
New Delhi, November 7, 2025: The Supreme Court of India has ruled that every accused person must be given written grounds of arrest, irrespective of the law under which they are detained. The Court stated that merely informing the accused verbally is not sufficient and that the written document must be provided in a language the accused can understand. The order aims to strengthen transparency, uphold constitutional rights, and prevent misuse of arrest powers by authorities.
This landmark decision reinforces the protection granted under Article 22 of the Constitution and ensures that an individual’s right to know the reason for their arrest is honored in both spirit and practice. Legal experts believe this directive will greatly reduce arbitrary detentions and promote accountability in policing and investigative procedures. The ruling is expected to set a uniform standard across all states and agencies, including central investigating bodies.
