
New Delhi, November 13, 2025 — The Delhi High Court has directed the central and state governments to frame comprehensive rules to deal with cases of convicts who are physically or mentally incapacitated and unable to surrender after their conviction. The court observed that the absence of clear guidelines often leads to confusion and humanitarian challenges in such situations.
A bench led by Justice Swarana Kanta Sharma noted that authorities must ensure a balance between upholding justice and protecting the rights of the ailing convicts. The court has sought a detailed policy framework within a fixed timeframe, emphasizing medical evaluation, humane treatment, and legal clarity in handling such cases.
